Terms of Use

These Terms of Use ("these Terms") set out the conditions for using the app Promise Pocket / 約束ポケット ("the App") provided by KENTA OSAWA ("we," "us," or "our"). By using the App, the user is deemed to have agreed to these Terms.

1. Scope

These Terms apply to the relationship between us and the user regarding use of the App. Any rules, guidelines, or notices that we separately establish in relation to the App also form part of these Terms.

2. Use of the App

The user shall use the App in accordance with applicable laws and these Terms. The user uses the App at the user's own responsibility.

3. License

Subject to compliance with these Terms, we grant the user a personal, non-exclusive right to use the App. This right is non-transferable and may not be sublicensed.

4. Fees and Payment

If the App is offered for a fee, the user shall pay according to the price and conditions shown on the store.

Charges, payments, billing, and refunds are, in principle, handled in accordance with the systems and terms of Apple App Store, Google Play, or other platform providers. We do not separately guarantee refunds.

If the App offers any in-app purchases, the content shown on each store's purchase screen applies.

5. Prohibited Conduct

In using the App, the user shall not engage in any of the following:

• Acts that violate laws or public order and morals
• Acts related to criminal activity
• Unauthorized use, modification, reverse engineering, decompilation, or disassembly of the App
• Acts that interfere with the operation of the App
• Unauthorized access or attempts to gain it
• Acts that cause damage, disadvantage, or discomfort to other users or third parties
• Acts that infringe the intellectual property, privacy, reputation, or other rights or interests of us, other users, or third parties
• Using the App in a manner not originally intended
• Acts that we deem inappropriate

6. Intellectual Property Rights

All copyrights, trademarks, and other intellectual property rights in the App and related to the App belong to us or to third parties holding legitimate rights. The license under these Terms does not constitute a transfer of these rights.

7. Changes, Suspension, and Termination of the Service

We may change the content of the App, suspend its provision, or terminate it without prior notice to the user. We are not liable for any damage thereby caused to the user beyond the extent permitted by law.

8. Warranty and Disclaimer

We make no warranty regarding the App, including but not limited to the following:

• That it is fit for the user's particular purpose
• That it is continuously available
• That it is free of defects, errors, or bugs
• That it works properly on all devices, OSes, and environments
• That notifications are always displayed at the exact time
• That forgotten promises, missed replies, or missed confirmations can be completely prevented

We are not liable for any damage incurred by the user through use of the App, except in cases of our willful misconduct or gross negligence.

9. User Data and Stored Information

The handling of data entered and stored by the user in the App is governed by the separately established Privacy Policy. The App stores usage data on the device. Data may be lost due to reinstallation, device change, device failure, or other circumstances.

10. Suspension of Use

If the user violates these Terms, or if we determine that continued use of the App is inappropriate, we may, without prior notice, suspend the user's use of the App or take other necessary measures.

11. Changes to These Terms

We may change these Terms due to legal changes, changes to the App, or other reasons. If important changes are made, we will provide notice in the App or on this page. If the user uses the App after a change, the user is deemed to have agreed to the revised Terms.

12. Severability

Even if any provision of these Terms, or part of it, is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. Governing Law and Jurisdiction

The interpretation and application of these Terms are governed by the laws of Japan. In the event of a dispute regarding the App, the court having jurisdiction over our location shall be the exclusive agreed court of first instance.
